SUSHMITA HALDER
Sushmita heads the infrastructure and data protection practice at the firm. She has over 17 years’ of experience advising on, among others, upstream and downstream sector (oil and gas), power sector (renewable and non-renewable), data protection (including GDPR), project finance, commercial contracts, labour laws and general corporate transactions.
In the area of energy/infrastructure she has advised on power purchase agreements, production sharing contracts, joint operating agreements, oil and gas procurement contracts, technology licensing agreements, gas sale agreements, gas transportation agreements, EPC contracts, and other infrastructure contracts. She has also advised on project finance transaction, including negotiation and drafting of transaction documents. In the area of data protection, among others, she has advised client on compliance requirement under GDPR, drafted privacy policy, terms and conditions for use of website and advised on breach/unauthorised disclosure of data. She has also advised on labour laws, health and safety compliance, CSR (Corporate Social Responsibility) and had been part of the Internal Complaint Committee on Sexual Harassment for corporate entities.
Sushmita has graduated from National University of Juridical Sciences, Kolkata (2005) and worked with leading Indian law firms Khaitan & Co and Trilegal and multinational energy companies Reliance Industries Limited and BG Group (part of Shell Group). She has a Master in Oil and Gas Law from the University of Aberdeen, United Kingdom.
SRI HARSHA PEECHARA
Harsha leads the dispute practice at the firm and has over 16 years of experience in advising on commercial litigation and arbitration. He has extensive experience of civil and commercial litigation in Indian courts, including before the Supreme Court of India, the Delhi High Court, the National Green Tribunal, the National Consumer Commission, the Appellate Tribunal for Electricity, the Competition Appellate Tribunal and National Company Law Tribunal. He has also appeared in several arbitrations on behalf of various clients including ONGC Videsh, IBM, Oil India Ltd. and Government of Delhi, New Delhi Municipal Council, etc.
Harsha graduated from the National Law School of India University in Bangalore (2004) and completed his LL.M. from the George Washington University School of Law, Washington D.C in 2007. He is licensed to practice law in India and is also a member of the New York Bar.
RAJIV KR CHOUDHARY
Rajiv leads the intellectual property practice at the firm and has over 15 years of experience in advising on commercial IP acquisition, litigation, and arbitration. He has extensive experience of civil and commercial litigation in Indian courts, including before the Supreme Court of India, the Delhi High Court, the Competition Commission, the Intellectual Property Appellate Board, and the National Company Law Tribunal.
Rajiv has represented several defendants in multiple IPR (patent) litigations at the Delhi High Court and before the Competition Commission of India. Rajiv advises handset brands and Indian standard-setting bodies in relation to various issues related to SEPs and FRAND. He is also one of the largest filers of trademarks in India having prosecuted more than 3000 trademark applications in the past two years alone.
Rajiv is one of the founders of the Fair Standards Alliance, a Brussels based non-profit body set up in 2015 to promote licensing of standard essential patents that are Fair, Reasonable and Non-Discriminatory. (www.fair-standards.org).
Rajiv graduated in 2000 from the University of Nagpur, with a Bachelor’s Degree in engineering (electronic design technology). He received his LL.B. in June 2006 from the University of Delhi, MBA in 2003 from FSM, Delhi, and his LL.M. degree (IP & Anti-Trust Laws) from the George Washington University Law School, Washington D.C. in May 2007.
PRIYANKA HAVELIA
Priyanka has over 15 years of experience and advises on general corporate, M&A, technology and media transactions. She has diverse experience of representing big corporate houses on a variety of legal matters including on cross-border investments and financings transactions. She has advised on legal due diligence, structuring and drafting and negotiation of the investment documents.
She has acted for big corporates in various sectors including IT, automobile, energy and oil & gas and has also advised listed companies on joint ventures, transfer of business, acquisition of minority/controlling stake and PE investments. Further, she has rendered regulatory and corporate advice to listed and unlisted companies on their day-to-day business including commercial contracts, technology collaborations/licensing, FDI, company law and SEBI related matters.
In the media & entertainment sector, Priyanka has advised multiple producers and A-List studios in the Bollywood and TV industry on various aspects of copyright law, contractual and financing matters including complex international co-production arrangements and has drafted contracts related to all phases of motion picture rights acquisition, financing, production and distribution.
In addition to being a qualified lawyer, Priyanka is also a qualified company secretary. She has worked with some of the leading law firms in India including Trilegal and J. Sagar Associates.
ASHISH TIWARI
Ashish has 10 years of experience in commercial litigation and alternative dispute resolution practice. He is enrolled with Delhi Bar Council and is also a qualified “Advocate on Record” of the Supreme Court of India. He specializes in alternative dispute resolution and regulatory disputes. He has been advising several high-profile clients including public sector undertakings, municipal bodies, and Government Authorities, and represented them before the Delhi High Court, Supreme Court as well as in a number of Arbitration cases. Ashish also regularly appears before the NCLT, NCLAT and APTEL.
Ashish has successfully represented in several high-stake arbitration matters and has also been associated with the Petroleum and Natural Gas related matters and issues arising under the PNGRB Acts and various regulations made thereunder including authorization and tariff-related matters. Ashish is also a fellow member of the Institute of Company Secretaries of India.
